Terms and Conditions
New Health Yoga Therapy
These are the general terms and conditions that apply to the establishment and execution of all agreements concluded between New Health Yoga Therapy and users of the facilities and services of New Health Yoga Therapy.
The general terms and conditions also include rules for the use of the facilities of New Health Yoga Therapy and serve as house rules.
I. DEFINITIONS

General Terms and Conditions: these General Terms and Conditions of New Health Yoga Therapy, which are published on the website of New Health Yoga Therapy: www.newhealthyogatherapy.nl.

NHYT: abbreviation for New Health Yoga Therapy.

Website: the website of NHYT: www.newhealthyogatherapy.nl.

Contact Form: the online registration form on the NHYT Website.

Participant: the person who uses the Website, has submitted the Contact Form, has registered for an Intake, Session, or Group Workshop, or is attending an Intake, Session, or Group Workshop at NHYT.

Yoga Therapy: a customized program in which techniques from yoga, mindfulness, and coaching, combined with extensive biomedical knowledge, Ayurveda, and nutrition, are applied in a personal program.

Introduction: online introductory conversation between Participant and NHYT.

Questionnaire: online questionnaire for Participants that NHYT may send prior to the Intake.

Intake: the intake interview (online or at the Studio) between NHYT and the Participant prior to a Session or Program.

Session: a private Yoga Therapy session offered by NHYT.
-
Program: a series of Sessions.
-
Group Workshop: Yoga Therapy offered in groups of up to 15 participants.
-
Studio: the space where NHYT offers its Sessions and Group Workshops.

House Rules: the behavioral and interaction rules that apply at NHYT.

Payment Request: The payment method whereby NHYT sends a payment request (via WhatsApp or email) to the Participant who has requested the product or service of NHYT.
II. APPLICABILITY
-
The General Terms and Conditions apply to the establishment and execution of all agreements concluded between NHYT and Participants of the facilities and services of NHYT.

By completing the Contact Form or participating in a Session at NHYT, the Participant declares to agree to the applicability of these General Terms and Conditions.
III. INTRODUCTION, INTAKE, SESSION, PROGRAM, OR GROUP WORKSHOP – GENERAL

The Introduction is online, free of charge, and optional.

The Questionnaire can be sent online by NHYT after the Introduction or after completing the Contact Form.

The Intake is mandatory for every Participant prior to attending Sessions, Programs, and Group Workshops.
-
An Intake, Session, Program, and/or Group Workshop is strictly personal and non-transferable.
IV. INTAKE - CONDITIONS

After full payment of the Intake, the Intake will be scheduled in consultation between the Participant and NHYT based on availability.

Up to 48 hours prior to the scheduled Intake, the Participant can cancel in writing with NHYT for the Intake, including by email or WhatsApp message. NHYT will then contact the Participant as soon as possible to reschedule the Intake.

In the event of cancellation within 48 hours prior to the scheduled Intake, the Intake will be forfeited, and the Participant will need to book a new Intake.
V. ATTENDING INDIVIDUAL SESSIONS - CONDITIONS

Prior to attending an single Session, the Participant must separately book an Intake, unless the Participant has previously undergone an Intake at NHYT prior to individual Sessions or as part of a Program.

A single Session can be booked after full payment for the Session.Top of Form

NHYT will contact the Participant as soon as possible after full payment for the Session to schedule the Session based on availability.

If a Participant cancels a scheduled Session at least 48 hours in advance, NHYT will do its utmost to reschedule the Session for makeup. If a Participant cancels a scheduled Session less than 48 hours in advance, the Session will be forfeited.

The cancellation as referred to in Article IV.1.4) above must be done in writing to NHYT, including by email to bettine@newhealthyogatherapy.nl or by WhatsApp message to +31 6-48338189.

VI. SESSIONS BASED ON A PROGRAM - TERMS AND CONDITIONS

A Program can be booked after full payment for the respective Program.

The Intake is included in the price of the Program.
-
Each Program entitles the Participant to a certain number of Sessions within the timeframe of the Program.

NHYT will contact the Participant as soon as possible after full payment to schedule the Sessions of the respective Program based on availability.

The start date of a Program is the day on which the first Session of the Program is scheduled.
-
A Program is valid for the duration and number of Sessions of the respective Program.
-
The timeframe of a Program cannot be paused once the Program has started.
-
If a Participant cancels a scheduled Session at least 48 hours in advance, NHYT will do its utmost to reschedule the cancelled Session within the duration of the Program. If a Participant cancels a scheduled Session less than 48 hours in advance, the Session will be forfeited.

The cancellation as referred to in Article IV.1.8) above must be done in writing to NHYT, including by email to bettine@newhealthyogatherapy.nl or by WhatsApp message to +31 648338189.

VII. GROUP WORKSHOPS - TERMS AND CONDITIONS

A Group Workshop is hosted on predetermined dates. NHYT can determine a minimum and maximum number of participants when announcing the Group Workshop.

NHYT may impose conditions for participation in the Group Workshop, such as booking an Intake prior to the Group Workshop.

Participants who meet the participation requirements can book the Group Workshop based on availability.
-
A spot in a Group Workshop is only confirmed after full payment for the Group Workshop.

If a Participant misses Sessions from the Group Workshop, no (partial) refund will be given.

VIII. PAYMENT AND PRICE CHANGE

All sales at NHYT are strictly personal and non-transferable. NHYT does not provide refunds.

NHYT reserves the right to change the prices of the Intake, single Sessions, Programs, and Group Workshops, and/or other products and/or services.

Price changes do not apply to sales concluded before the respective price change.

Price changes as referred to in this article are immediately visible on NHYT's website.

The Participant can purchase NHYT's products and/or services by means of a Payment Request sent by NHYT to the Participant. Once NHYT has received the payment for the Payment Request, booking of the respective service can take place or the respective product can be collected at NHYT.
IX. HOUSE RULES
NHYT reserves the right to refuse Participants who display unacceptable behavior at any time, including but not limited to discriminatory, racist, sexual, aggressive, or otherwise unacceptable behavior in the eyes of NHYT, without any right to refund, compensation, or damages for the respective Participant.
X. LIABILITY
1. General

The Participant follows the Intake, Session, and/or Group Workshop at their own risk.

NHYT accepts no liability for physical injury, loss, or damage related to the participation of the Participant in the Intake, Session, and/or Group Workshop.

NHYT only works with certified yoga therapists.
-
To minimize the risks of injuries and damage, NHYT follows the following guidelines for Participants. It is the Participant's responsibility to adhere to these guidelines:

Ensure that you are aware of what Yoga Therapy entails before participating in a class. You can consult the Website for this purpose and contact NHYT by email at info@newhealthyogatherapy.nl for more information or clarification.

If you are unsure whether you are physically capable of participating in Yoga Therapy: Always consult a doctor and/or the person who is treating you before starting Yoga Therapy.

If you have (recently) undergone surgery, have chronic health issues, have an injury, and/or are under medical treatment: Always consult a doctor and/or the person who is treating you before starting Yoga Therapy.

If you are pregnant: Always consult a doctor and/or your midwife before starting Yoga Therapy.

If any of the situations mentioned in sections b), c), and/or d) above apply to you or if you have other physical complaints, always inform NHYT prior to the Session or Group Workshop.

Ask the yoga therapist questions when you don't understand an exercise or posture or when you don't understand an instruction.

Loss of or damage to property

Leaving belongings in the changing rooms or other areas of NHYT is at the Participant's own risk.

NHYT accepts no liability for loss or damage related to the Participant leaving belongings at NHYT.

XI. PERSONAL DATA

NHYT respects the privacy of its Participants.

NHYT collects personal data from Participants for the purpose of maintaining its membership database, processing payment instructions, and for administrative and informational purposes. NHYT handles this personal data with care and complies with the provisions of the Personal Data Protection Act.

XII. AMENDMENTS
NHYT may amend these General Terms and Conditions at any time. The version of the General Terms and Conditions available on the Website is always the latest and applicable version.
XIII. SEVERABILITY

If a competent court were to find any provision of these General Terms and Conditions unlawful, invalid, or unenforceable, the respective provision in the General Terms and Conditions is waived, but the remaining provisions of these General Terms and Conditions remain in full force and effect.

If a competent court were to find any provision of these General Terms and Conditions partially unlawful, invalid, or unenforceable, the provision remains in force to the extent that it is lawful, valid, and enforceable.
XIV. ENTIRE AGREEMENT
The General Terms and Conditions and the privacy statement of NHYT constitute the entire agreement between the Participant and NHYT, replacing any previous commitments and agreements.
XV. APPLICABLE LAW

Dutch law applies to all agreements to which these General Terms and Conditions apply unless mandatory law stipulates otherwise.

All disputes relating to agreements to which these General Terms and Conditions apply shall be settled by the competent Dutch court.
